Bidder Verification: The identity of all bidders will be verified. EACH PARTY HEREBY KNOWINGLY, VOLUNTARILY AND INTENTIONALLY WAIVES (TO THE EXTENT PERMITTED BY APPLICABLE LAW) ANY RIGHT IT MAY HAVE TO A TRIAL BY JURY OF ANY DISPUTE ARISING UNDER OR RELATING TO THIS AGREEMENT AND AGREES THAT ANY SUCH DISPUTE SHALL BE TRIED BEFORE A JUDGE SITTING WITHOUT A JURY.

 

Guaranty Agreement: By submitting a bid in the name of a business entity or corporation, the individual submitting the bid enters into a guaranty agreement whereby he or she personally guarantees payment to Harris Real Estate & Auction of any bid amount not paid when due by the business entity or corporation, for any reason, together with all collection expenses incurred to enforce collection, including a reasonable attorney’s fee.

Limitation of Liability: If, for any reason, Harris Real Estate & Auction is unable to make available or deliver any Purchase, or portion thereof, or documentation required in respect of any Purchase at time of pickup, the sole liability of Harris Real Estate & Auction if any, shall be the return of any paid monies in respect of such Purchase upon its return by Purchaser.

Disputes: Any dispute between Harris Real Estate & Auction and its Agents or Representatives and the Buyer(s) will be tried in a court of jurisdiction in Marshall County, Kentucky. By bidding on any item, buyer agrees to all terms and conditions set forth.

Age Requirement: All bidders must be eighteen (18) years of age or older.

Purchased Items: All buyers are responsible for making sure that all items purchased are accounted for before leaving the designated pick-up location after the auction has closed.

Acceptance of Bid Prices: All bids are subject to seller confirmation unless noted as ABSOLUTE.

By registering for this auction, you understand and expressly acknowledge that an inherent risk of exposure to COVID-19 exists in any public place where people are present. In attending the auction or preview, you and any guests voluntarily assume all risks related to exposure to COVID-19, and waive, release, and discharge Harris Real Estate & Auction or any of their affiliates, directors, officers, employees, agents, contractors, or volunteers from any and all liability under any theory, whether in negligence or otherwise, for any illness or injury.

All property is sold ‘As Is, Where Is’. Statements, conditions, descriptions, weights, and measures on or about items are provided in good faith and only matters of opinion. Neither Harris Real Estate & Auction nor the Seller make guarantees and/or warrantees, expressed or implied about the merchantability of items and/or fitness for a particular purpose.

Bidder acknowledges having inspected the property, whether in person or online, and to be satisfied with the same prior to bidding. Bidder is solely relying upon their own expertise when choosing to make a purchase. Harris Real Estate & Auction has attempted to provide the correct item description and/or pictures, however any errors or omissions in any provided format, description, or picture does not affect/void the sale in any way.

All announcements made by Auctioneer at/during the auction will take precedence over previous printed materials, website, or other statements and/or descriptions made.

Buyer agrees that under no circumstances whatsoever will Harris Real Estate & Auction or Seller ever be liable to any Buyer for an amount greater than the purchase price of the item purchased and only when in agreement that statement materially was intentionally incorrect.

Harris Real Estate & Auction may reject or cancel a bid for any reason. The record of the auction made by Harris Real Estate & Auction shall be conclusive. This is a Public Auction and as such, all qualified Bidders may bid including Harris Real Estate & Auction owners, family members, employees, and any company, group members, or employees. Disputes: Auctioneer shall designate the winning Bidder after each item is auctioned. If a dispute arises between two or more Bidders, Harris Real Estate & Auction reserves the right to reopen bidding. The Auctioneer’s designation of a Buyer shall be final. Any disputes that require litigation shall be administered and shall be enforced and brought in The State of Tennessee in Davidson County and governed by the laws of the State of Tennessee. Harris Real Estate & Auction shall select the venue for the litigation proceedings whether by arbitration or litigation.
